Get ready to be sued

6 posts in this topic

Seems somehow Nelson & Pade have been granted two patents on the "procedures of aquaponics".

Not systems or designs but the concepts.

They are now sending out letters demanding companies that make/sell systems to cease.

Reading through the patent, claim 10 seems to be the part that differentiates their process from the common process.   The bad thing is that they didn't even use correct terminology in the patent and a good patent lawyer will tear them a new one the first time they try to defend it in court.  I look at this similar to the Happy Birthday song company that demanded money for decades only to loose in court and is now facing having to repay the money they had collected.

Their description is oddly similar to Paul's design.... .        That might be an entertaining court battle.   Still trying to figure out how they are patenting UVI designs some 20 years later...

As I mentioned on the Facebook page for UVI, I don't think they really care about anything but somebody copying their turn-key system and selling it commercially as a turn-key system.  I'd probably want to do the same if I were doing what they are doing.  I doubt this ever makes it to a court case because they would have difficulty proving the validity of their patent.  Anyone doing custom design is going to fall outside of what the patent is intended for.  What it does is gives them a strong arm against somebody duplicating their model.

I think their intentions go beyond that Dave...

As to the patent, or anyone that might receive a letter claiming they might be "copying" the N&P system.....

I think any such recipient should merely respond... " "no sorry, we designed our system based on a design that pre dates your patent application"....

And send them the link below which documents and illustrates Joel Malcoms "commercial trial" in 2009.. with specific reference as to "mineralisation"... ;)

Besides the patents being b..s they will not stand as they are not unique.

There are more patents like this; example https://www.google.com/patents/US8839742

The guys from this link are also very productive on patents...

I am facing it now and then that clients (or draft people as a matter of fact) claim IP of my designs, and inquire on getting patents on my work. Always hate this, as this can potentially harm my business.
